Grupo Danelca 2012 SL aim to be a support centre for clients TV and Audio in the home.

By mail and by Phone and live support (ticket system)

Grupo Danecla 2012 S.L. is a re-seller of ranges of IPTV services. Grupo Danelca 2012 SL is not the IPTV provider.

The support we provide we offer regardless if the service is received via one of our providers or via the clients own selected provider. Make sure you have a suitable broadband connection and unlimited bandwidth from your ISP before ordering.

Grupo Danelca 2012 SL takes no responsibility for, and will not be liable for, the service is temporarily unavailable due to technical issues beyond our control.

The used and recommended provider reserves the right to change accessible online content.

Grupo Danelca 2012 SL pay for each customer that gets invoiced via a support subscription from us, for the rights to retransmit channels in Spain.
Using the software/middleware provided by one of the providers used by Grupo Danelca 2012 S.L. the client has a legal agreement between Grupo Danelca 2012 S.L. and themselves. To endorse Grupo Danelca 2012 S.L.s terms and conditions electronically has the same legal significance as a signature on any other contract. If any discrepancies between the customer and Grupo Danelca 2012 S.L.s, the terms applied by the Spanish legal system and the anytime given rules.

Grupo Danelca 2012 S.L. are using Spanish bank Cajamar for transactions.

1. Terminology

The following terminology applies to these Terms and Conditions, as well as any and all other Agreements:

- Client, You or Your refers to you, the person accessing this website and accepting Company's terms and conditions

- Account refers to a private web page with private billing and subscription information

- The Company, Ourselves, We and Us refer to Grupo Danelca S.L.

- Party and Parties refer to both the Client and ourselves, or either the Client or ourselves

- Service, Provider, Subscription and Order refer to optional paid-for services and thirdparty providers we have available on our Website

- Agent and Reseller refers to affiliates and other third party business partners marketing the website and the services it provides

- Website and Site refer to www.shop.danelca.com, the website you are accessing now



Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.

Customer will indemnify Grupo Danelca 2012 S.L. for any liability for customer's use of Grupo Danelca 2012 S.L.'s services. This also applies if the customer had to violate the copyright, use of a protected trade name or other trademark rights through targeted publicly display, etc.

The selection/content can change at any given time, based on the availability of the content. Danelca only resell the middleware and software, but any content is provided from a supplier or is based on online content, Danelca have no control of any content, and changes in the access to specific content can not be insured. External Premium service is always up to the provider or the free access, if any changes are made and this effect the service to an extend the client can not continue, the client can stop any further payment and any extensions and future payments. The already paid service can not be refunded based on the selection/content provided in the software and middleware purchased through Danelca.

The running service provided in the systems sold by Danelca is optional to change at any time, the service sold is the software "not the content", and in anytime the content can change without any notice given.

3. COOKIES

We employ the use of cookies. By using the website you consent to the use of cookies in accordance with our privacy found on this website.

7. REMOVAL OF LINKS AND CONTENT FROM OUR WEBSITE

If you find any link on our Website or any linked web site objectionable for any reason, you may contact us about this. We will consider requests to remove links but will have no obligation to do so or to respond directly to you.



Whilst we endeavour to ensure that the information on this website is correct, we do not warrant its completeness or accuracy; nor do we commit to ensuring that the website remains available or that the material on the website is kept up to date.



8. OPTIONAL SERVICES AND PAYMENT

The service on some of the services we offer is a “PAY-AS-YOU-GO” service, this is a pre-paid service for access to the provider's websites and their functions.

The paid-for services provide technical means to access various content. Any listed services are subject to change based on availability and on our sole discretion without any prior notice. Any changes in the paid-for services will be published on the provider's main page of their site. We are not responsible for the accessible content, and you retain all responsibility for any and all third-party fees, as well as business or personal risks and liabilities related to use of data that you access using our site.



Upon full prepayment, the optional paid-for service is provided to you automatically. The service is a timed subscription that deteriorates every second until it runs out. You can check the end date of your billing using your account on the website. You are solely responsible for paying for your subscription discreetly



9. RECURRING PAYMENTS

Being a TV-Club member requires a binding period of at least 12 months.
Whether you chose to pay per month or per year, you will approve of a recurring payment the next period automatically, unless you give us the notice to stop this at least 1 month before next payment.

Grupo Danelca 2012 aim to re-sell a wide range of stable products and services, in case a product or a service is faulty or do not reach the expectations of the client, Grupo Danelca 2012 S.L. will try to change or swap this at the lowest possible cost for the client's, for TV-Club member this will happen at no extra cost what so ever as long as the equipment the client has is supported, the aim of this process is to have the support subscription covering alternative products/services



10.TV-CLUB MEMBERSHIP

As a TV-club member, you are guaranteed to have a working IPTV system, if for any reason a system should break down or stop working, you will be provided with a backup system within 24 hours.

If a system does not live up to the expectations of a client, the client can swap to other systems free of charge. This swap does not include service visits, unless the client has a membership where this is included, should this be the case, the hours spent swapping the customers system will be withdrawn from the service hours left on the membership.

Some memberships include service visits from our engineers.
When we send an engineer out to a client, if the service visits are included in the client’s membership, every visit will withdraw at least one hour from the leftover hours on the client's account.

Some memberships include free swap of equipment.
This free swap can be used if a, required by the service, piece of hardware is faulty, broken or has other malfunctions that affect the quality of the user experience.
The free swap does not include swapping functioning equipment and can not be used to upgrade with no malfunctions.

First in line services as a term.
Some membership includes first in line service. This means already existing appointments will be moved by the next office opening hours, to make room for a service visit at a client with this guarantee.
Danelca will at all times do the very best to fulfil first in line service, but there can be exceptions, where the engineer has been prevented by circumstances as traffic, disease, or accident.
First in line service, will still happen within normal opening hours.



11. REFUND POLICY AND DISPUTES

The Client, our associates and we have the right to terminate any Services Agreement for any reason, including the ending of services that are already underway.

Within 7 days from the first time an account is purchased and paid for, Client retains a right to claim a refund for that payment. Refunds are processed within 30 calendar days. As soon as the refund request is received all paid-for services related to that request are cancelled.

After the 7 days from the purchase are over, refund requests will not be processed. Existing accounts extended have no refund and the payments are considered a PAY-AS-YOU-GO payment.

Beyond that date, the Service is deemed to have begun and is, for all intents and purposes, underway.



Previously made recurring charges are subject to refund on our sole discretion. In all cases, means to process and deliver a refund are decided on Grupo Danelca S.L. sole discretion.



Opening a dispute with your payment processor (bank or otherwise) over an order with Grupo Danelca S.L. without our prior written consent immediately voids any and all service agreements between you and us. Chargebacks are strictly prohibited and may result in immediate account termination.



12. FORCE MAJEURE

Neither party shall be liable to the other for any failure to perform any obligation under any agreement, which is due to an event beyond the control of such party. This includes but is not limited to: network availability interruptions, traffic throttling, power cuts, or events like terrorism, war, political insurgence, insurrection, riot, civil unrest, an act of civil or military authority, uprising, earthquake, flood or any other natural or manmade eventuality outside of our control. Any Party affected by such event shall forthwith inform the other Party of the same and shall use all reasonable endeavours to comply with the terms and conditions of this Agreement as soon as it becomes possible again.



13. NOTIFICATION OF CHANGES

We reserve the right to change these conditions from time to time as it sees fit and your continued use of the site will signify your acceptance of any adjustment to these terms.



14. DISCLAIMER

To the extent that the website and the information and services on the web site are provided, we will not be liable for any loss or damage of any nature.



15. LAW AND JURISDICTION

This Agreement and any dispute or claim of whatever nature, whether contractual or non-contractual, arising out of or in connection with it shall be exclusively governed by and interpreted in accordance with the law of Spain, and this Agreement shall be construed in accordance with Spanish law. In relation to any legal action or proceedings arising out of or in connection with this Agreement (whether arising out of or in connection with contractual or non-contractual obligations), each of the Parties irrevocably submits to the jurisdiction of the Spanish courts.



16. REGIONAL SETTLEMENTS

In addition, the customer commits itself not to violate the rights of any kind. Grupo Danelca 2012 S.L. a Spanish Company is liable under the Spanish rule of general liability rules for damage caused by acts or omissions caused by Grupo Danelca 2012 S.L. with the following restrictions, that apply regardless of whether liability basis is negligence or based on other bases:

- Liability is limited to an amount not exceeding the payment within the vesting period for the service has given rise to the claim raised.



- Grupo Danelca 2012 S.L. is in no event liable for incidental or consequential damages, including lost profits, loss of production, loss due to stream data services.

If a liability, attributable to defective services from ISP or other network operator or contractor, the customer can not obtain compensation from the Grupo Danelca 2012 S.L.
